BMI Appeals DMX Rate-Court Decision

BMI has filed an appeal of the DMX decision issued by Judge Louis Stanton, BMI’s rate-court judge to the United States Court of Appeals for the Second Circuit. BMI’s appeal on behalf of its songwriters, composers and music publishers will seek reversal of a court decision that, according to DMX’s outside counsel, will allow DMX to “pay fees approximately 65% lower than those sought by BMI.” “On behalf of our… more
Merle Haggard Named 2010 Kennedy Center Honoree

Merle Haggard will add one more brilliant feather to his well-worn cap: Kennedy Center Honoree. The John F. Kennedy Center for the Performing Arts announced the 2010 recipients of the prestigious honor today, and the 2006 BMI Icon leads the short list. The gala is slated for December 5 in Washington, D.C., and will be broadcast on CBS. "The Kennedy Center celebrates five individuals who have spent… more
Kim Richey, One Day at a Time

If there’s a downside to songwriting, it’s that the process can be a lonely and solitary activity. Kim Richey resolves that conundrum by doing most of her writing with other people. “I love the social aspect of co-writing,” says Richey, who moved to London last year after spending more than two decades in Nashville. “Some of my closest friendships have come through co-writing, where I’ve gotten to… more
Editorial: Meeting the Challenge of the Growing Threat to Intellectual Property

BMI is appealing the decision of the rate court in the recent BMI v. DMX case, which would substantially reduce BMI’s ability to capture the full value of your creative works in the commercial background music service industry (see separate story). We think they got it wrong. The court relied on a small number of direct licenses negotiated by DMX that set fees at… more
SongCircle Music Contest Call for Entries

SongCircle Music, formerly The New York Songwriters’ Circle, is currently accepting submissions for its fifth annual Songwriting Contest. The “independent music development and A&R community” organization established the competition to discovery aspiring artists whose musical promise warrants a bigger stage. So far, the SongCircle Music contest has helped launch the careers of previous grand-prize winners Kate Voegele (Interscope), Company of Thieves (Wind-Up/Sony), Mieka Pauley, and Reed Waddle.… more
John Luther Adams, Finding a Way to Get Lost

Throughout his distinguished career as a composer, John Luther Adams has been considered an “outsider,” the moniker frequently bestowed on independently-minded artists (think John Cage and Morton Feldman) whose work places them outside the musical establishment. In many ways, this label fits. The New Yorker goes as far as to appoint Adams “the chief standard bearer of American experimental music.” To many, “outsider” is even doubly suitable,… more

Broken Bells Ring True

Six years ago, James Mercer and Brian Burton (now equal parts of Broken Bells) met on the ancient island Zealand, where they were both booked to play the Roskilde Festival —Mercer as frontman for indie rock band The Shins and Burton as fearless DJ/producer Danger Mouse. The two Americans — perfect strangers in a land of blighted Viking ships and throbbing nightclubs — got acquainted backstage, caught… more
