Music Licensing for Radio

2010 Radio License Extension

The current BMI Radio Station Blanket/Per Program License Extension Agreement will expire on December 31, 2009. BMI and the Radio Music License Committee (“RMLC”) have been meeting to discuss the terms of a new license agreement for the radio industry which will commence as of January 1, 2010.

In order to remain licensed for the period commencing January 1, 2010, stations have three (3) options as follows:

  1. Sign the BMI 2010 Radio License Extension Agreement (available here on-line); or

  2. Sign the RMLC Authorization for Music License Negotiations/Proceedings form; or

  3. Make an application to BMI for a license pursuant to the BMI Consent Decree. If stations choose to make their own Application, they may be required to appear before the BMI Rate Court, located in New York City, to prove that their station(s) are not similarly situated to the universe of radio stations which has elected to be bound by a new BMI/RMLC agreement and to give evidence as to the appropriate license fees for their station(s). The RMLC has recently provided BMI with a list of stations that they represent. If a station was NOT included on the RMLC’s list, such station(s) will be contacted by BMI to educate them on the above mentioned licensing options.
