BMI Logo Usage

TERMS AND CONDITIONS FOR USE OF BMI LOGOS

You may use the BMI Logos (“Licensed Marks”) contained herein provided you agree to abide by the terms of use set forth below for the BMI Logo you wish to utilize.

For personal stationary, business cards, websites and other means of indicating BMI affiliation or status, BMI affiliated songwriters, composers and music publishers (“BMI Affiliates”) may use the BMI Affiliate Logo.  BMI Customers and Licensees may use the BMI Licensee or Customer Logo to indicate that they are currently licensed by BMI to publicly perform works in the BMI repertoire.  BMI’s Conditions for Use also generally permit all websites, including Affiliate and Customer websites, to use BMI’s Main Logo and BMI.com Logo as a link to the BMI.com website. 

Approved Forms of BMI Logos/Licensed Marks

The approved forms of the BMI Logos referred to as Licensed Marks that may be used only pursuant to the terms of use set forth herein (the “license”) are:

General Terms of Use of Licensed Marks

• Each Licensed Mark above is a trademarked Logo belonging to BMI.
• If you use any of the Licensed Marks you agree that your presentation of the Logos shall retain the relative relationship of the dimensions (top, bottom, and sides), content, and color scheme of each original Licensed Mark.  The logos may not be revised or altered in any way, and must be displayed in the same form and color as produced by BMI.
• The logos may not be used in any manner that, in the sole discretion of BM, either: discredits BMI; tarnishes the reputation and goodwill of BMI; is false and/or misleading; violates the rights of others; violates any law, regulation or other public policy; or mischaracterizes the relationship between BMI and you, including but not limited to any use of the logo that might be reasonably construed as an endorsement, approval, sponsorship, or certification by BMI of the user, or the user’s business or organization, or as promoting the sale of the user’s products and services.
• BMI expressly reserves the right to withdraw any license granted to you herein and to request that you cease from any use of the Licensed Marks for any reason, including, but not limited to, if your use of the Licensed Marks violates the conditions of use herein or BMI’s Website Terms and Conditions.

Use of BMI Affiliate Logo by BMI Affiliates

BMI is pleased to provide BMI Affiliates with the right to use the BMI Affiliate Logo set forth above to indicate their status as a BMI Affiliate on their own websites, business cards, stationery and like materials, subject to the conditions herein. BMI Affiliates may not use any other of the Licensed Marks set forth above to indicate their affiliation on such business related materials.

• Any current BMI Affiliate in good standing may apply the BMI Affiliate Logo to any materials, documents, or communications that they use, whether published online, in print, or in the form of CDs or otherwise (for example: business cards, stationery, websites, “jewel jackets”, “CD liner notes” or tray cards of CDs, tapes, etc.) for the sole purpose of identifying your works as being licensed by BMI. If you wish to use any of the Licensed Marks as a BMI Affiliate, you understand that you are expected to comply, in addition to the terms set forth herein, with all guidelines from BMI’s Terms and Conditions for their Trademarks.  The permission required by those terms may be obtained by a BMI Affiliate for uses of the BMI Affiliate Logo authorized herein by clicking on the “I Accept” button below.  Prior written permission for use of any other Licensed Mark or any other use of the Affiliate Logo must be obtained in writing by contacting BMI.
  
  If the BMI Affiliate Logo is applied to publications, such as CDs, jewel jackets and liner notes, relating to recordings of your musical compositions, you agree that such use will be for the limited purpose of designating such materials as including musical compositions written and/or published by a BMI Affiliate.

BMI expressly reserves the right to withdraw this license and to request that you cease from any use of the Licensed Marks for any reason, including if your use of the Licensed Marks violates the above terms and conditions, or if you cease to be an BMI Affiliate in good standing.

Use of BMI Licensee Logo by BMI Customers

If you are a current BMI Customer in good standing and wish to use the BMI Licensee Logo set forth above, you may do so subject to the conditions herein, and provided that you agree that your use shall be limited to true and correct copies of the exact Licensed Mark of the BMI Licensee or Customer Logos above. You may determine whether you are a licensed customer in good standing by contacting your BMI licensing representative. If you have general questions about BMI licensing please see the Licensing Section of BMI.com.  You may obtain the permission to use the BMI Licensee or Customer Logos required by BMI’s Trademark terms of use by clicking on the “I Accept” button below.  For use of any other BMI trademark you must obtain prior written permission by contacting BMI.

Use of BMI Logos by Websites Linking to BMI’s Website

Any website may use the BMI Main Logo or the BMI.com logo as a link to the BMI.com website, subject to the conditions herein. You agree that your use of either of these two BMI trademarks in connection with your Website shall be limited to true and correct copies of the exact BMI Logos set forth in the Approved Forms of BMI Logos on bmi.com, and that your use of such trademark shall be used for the sole and limited purpose of linking to BMI’s Website pursuant to the terms set forth in BMI’s Terms and Conditions.  You may obtain the permission required by those terms and conditions to use those two trademarks as links by clicking on the “I Accept” button below.  For any other trademark or service mark of BMI or for any other use of any trademark/service mark, you must obtain BMI’s prior written permission by contacting BMI.

Licensed Marks Belong to BMI

Use of the Licensed Marks as provided herein shall create no rights for users in or to the BMI Logos or their use beyond the terms and conditions of this limited and revocable license.  The logos shall remain at all times the sole and exclusive intellectual property of BMI.  BMI shall have the right, from time to time, to request samples of your use of the logo(s) from which it may determine compliance with these terms and conditions.
